1. Introduction

2. General Terms of Refund
a. No Automatic Refund:
All payments made towards our services are considered final once the service process has commenced, unless specifically stated otherwise in writing.
b. Refund Eligibility:
A refund may be considered by the Company only under the following conditions:
- Duplicate payment due to a technical error or transaction failure;
- Payment made but service not initiated due to the Company’s inability or discontinuation of that specific service;
- Erroneous or unintentional payment for an unavailable service, subject to management approval.
c. Non-Refundable Services:
The following are strictly non-refundable:
- Government fees, challans, or statutory payments made on behalf of the User;
- Professional, consultancy, or service fees once the processing of the application or assignment has commenced;
- Fees paid towards franchise, branding, or non-transferable licenses;
- Charges paid to third-party or affiliate partners.
d. Partial Refunds:
In cases where only a portion of the service is completed, and a genuine reason is found valid by the Company, a partial refund may be issued after deducting the applicable administrative and professional charges.
3. Refund Procedure
- Users seeking a refund must submit a written request to contact@bharatesevakendra.com within 7 working days of payment, clearly mentioning the reason and proof of payment.
- The Company shall review the request, verify the transaction, and determine eligibility within 15 working days.
- Approved refunds shall be processed within 7–10 working days thereafter through the same mode of original payment or as otherwise notified.
- All refund decisions shall be final and binding, at the sole discretion of the Company’s management.
4. Cancellation Policy
a. User-Initiated Cancellations:
- Cancellations must be requested in writing before the initiation of service.
- Once the process or documentation has begun, cancellation requests will not be entertained.
b. Company-Initiated Cancellations:
- The Company reserves the right to cancel or discontinue any service at its discretion due to regulatory changes, lack of required documentation, or other operational reasons.
- In such cases, the Company may issue a full or proportional refund, as applicable.
5. Service Responsibility and Limitations
- The Company provides facilitation and advisory services based on the information provided by the User.
- The Company is not responsible for delays, denials, or rejections by government departments, statutory authorities, or third-party systems.
- Users are solely responsible for providing accurate and complete documents and information.
- The Company’s role does not include decision-making or issuance of government approvals, licenses, or certifications — it acts as an intermediary and facilitator.
6. User Liability and Compliance
- The User is fully responsible for ensuring that all documents and declarations submitted are authentic and compliant with applicable laws.
- The Company reserves the right to deny services or refunds if fraudulent, misleading, or illegal activities are detected.
- The User agrees to indemnify and hold harmless the Company, its officers, employees, and representatives from any loss, claim, or damage arising from non-compliance or misuse of our Services.
7. Limitation of Liability
- The Company shall not be liable for any indirect, incidental, or consequential loss, including but not limited to financial loss, opportunity loss, or reputational damage arising from use or inability to use the Services.
- The Company’s total liability, under any circumstances, shall not exceed the total amount paid by the User for the specific service in question.
- The Company shall not be responsible for technical errors, system interruptions, or delays beyond its reasonable control.
8. Regulatory and Legal Compliance
- All transactions, communications, and processes are governed by the applicable laws of India, including the Information Technology Act, 2000, and the Digital Personal Data Protection Act, 2023.
- Users must comply with all applicable local, state, and central laws while availing any of the Company’s Services.
- The Company shall cooperate with legal authorities in case of investigation or lawful request.
